Better a witty fool than a foolish wit!

Don't be a foolish wit by missing out this informative and entertaining CLE and cocktail happy hour presented by Littler Mendelson!

As the national conversation grows regarding equal justice, employers are motivated to understand their obligations in this fast-changing landscape. Littler attorneys will discuss corporate diversity and inclusion initiatives, equal pay requirements, and recommendations for compliance. Incorporating data and legal limitations into your strategies will help develop and tailor initiatives that can withstand legal scrutiny and maximize long-term impact.

Discussions will cover the following:

  • General principles to help navigate the legal framework applicable to diversity & inclusion and equal pay intiatives
  • Interpreting and maximizing the utility of data related to these initiatives
  • Potential strategies for improving diversity & inclusion and pay equity
  • Long-standing and novel legal theories to take into consideration

Babst Calland’s Board Chairman and Management Committee Member, Christian A. Farmakis, and his colleague, W. Dane Fennell, will discuss how in-house legal departments and their law firms are rapidly increasing the deployment of “Legal Tech” and the utilization of Alternative Legal Service Providers (ALSPs).  Mr. Farmakis and Mr. Fennell will discuss how these trends are impacting the practice of law, both at in-house departments and at their outside legal counsel.  They will touch on which Legal Tech has already “taken hold” and which ones are still emerging.   Throughout their presentation, they will share some personal experiences and “lessons learned” from utilizing certain Legal Tech and managing and leading the efforts of Solvaire, Babst Calland’s affiliated ALSP.

As technology continues to evolve, new laws, rules, and regulations affect how we transact business every day – everything from customer and client data to websites to office technology is impacted. This webinar will address recent trends governing data privacy, consumer rights, and workplace technology.

The COVID-19 pandemic has left an indelible impact on the workplace, causing employers to deal with a wave of medical leaves and a shift to virtual workplace. As a result, employers face a host of compliance issues in navigating leave and accommodation issues.

In this complimentary webinar, Littler attorneys will tackle the most common and difficult leave and accommodation scenarios that employers have encountered during the COVID-19 pandemic and will provide practical suggestions on how employers can address these situations.

Through the use of case studies (and maybe a tiny bit of humor), we will cover:

  • Is an employee who tests positive for COVID-19 eligible for FMLA leave?
  • How to address an employee who has a generalized fear of returning to work because of the pandemic.
  • Whether FMLA leave applies when an employee claims they cannot return to work during the pandemic because they have an underlying medical condition.
  • Can an employee take FMLA leave to sit at home during a pandemic with a family member who is considered high risk?
  • Is physical presence at work critical anymore? Handling work-from-home requests during the pandemic.
Other Transaction Authority (OTA) Agreements and Non-Traditional Government Contractors: Opportunities, Compliance Requirements, and Recent Experience with Operation Warp Speed (OWS)

Other Transaction Authority (OTA) agreements are intended to provide a flexible framework for traditionally-commercial companies to enter into the federal government contracting space.  This allows the government to pursue research and development and prototype-based projects with innovative industry partners not accustomed to doing business with the government.  Despite this flexibility, as with contracts based on the Federal Acquisition Regulation (FAR), OTAs require compliance with government-specific clauses, laws, and regulations, which may create obligations that are unfamiliar to companies not accustomed to partnering with the government.  A recent example of this is Operation Warp Speed (OWS), in which the government leveraged the OTA framework to provide funding and encourage participation among non-traditional government contractors for the development of medical countermeasures in response to COVID-19, without being subject to many of the FAR’s unique, and possibly unfamiliar, compliance requirements.  This roundtable will discuss matters relating to compliance with government-specific requirements (e.g., intellectual property, cybersecurity, and subcontracting requirements) as well as performance-based requirements (e.g., clinical and non-clinical objectives and any commercialization/manufacturing requirements), highlighting OWS as a real-world, relevant example.
