Session I – Navigating Ethics in the Evolving World of ESG

As Environmental, Social and Governance (ESG) continues to gain momentum across industries of every sort, there is no shortage of articles, podcasts and webinars focused on the growing movement.  While many of these are geared towards investors and the boardroom, this presentation will focus specifically on the role of the in-house lawyer, highlighting some of the key ethical issues that can arise as ESG strategies are developed and implemented in what may be best described as a minefield of evolving regulations and best practices.  Real-world hypotheticals will be used to walk through how the Rules of Professional Conduct governing confidentiality, competency, loyalty and who you represent can apply in this changing landscape.

Session II – The Attorney-Client Privilege and the Role of In-House Lawyers

This presentation addresses the attorney-client privilege, attorney work product doctrine, and attorney confidentiality obligations, including recent developments in these areas.  Geared toward an audience of in-house attorneys, the program highlights issues that in-house counsel should consider in advising their clients and educating their business counterparts about privilege and confidentiality.

The technology is evolving quickly but brings with it both convenience as well as a number of legal issues. This program will cover the top things you should know about the privacy-related impacts of artificial intelligence, including in the context of biometrics and facial recognition. Presenters will address topics such as transparency around the use and operation of AI-powered products and services, the current legal regime in the U.S. governing AI and, in particular, biometrics, how current and upcoming U.S. consumer data privacy laws may impact the use of AI and machine learning models, and recent litigation and enforcement actions in the AI and biometric space (particularly under Illinois’ Biometric Information Privacy Act (“BIPA”)).

Non-fungible tokens (NFTs) have exploded in popularity, and in some well-publicized cases, have commanded shockingly high prices.  The IP issues in the world of NFTs can seem new and different, but are they really?  We’ll discuss the opportunities and risks for your companies in the world of NFTs, and in particular, who has the rights to mint and sell NFTs; what rights are being sold, licensed, or transferred; and what steps your legal department can take to monitor and enforce its IP rights when it comes to NFTs.  At the end of the day, we may conclude that the more things change, the more they stay the same.
