Over the course of the past year, most U.S. businesses steadily ramped up their return-to-office efforts with the oft-stated goal of “returning to normal.” However, the return to the physical office has often proceeded in fits and starts, marked by the emergence of new COVID variants and other respiratory viruses, the prevalence of “long COVID,” growing numbers of employee requests for workplace accommodations based on both physical and mental health conditions, and proliferating state and local requirements. HR and leave management professionals are challenged daily to interpret and update their pre-COVID absence and accommodation practices, while courts and arbitrators are increasingly receptive to novel requests to modify the way we work.

In a nutshell, what we have “returned” to feels very different than what we left. Please join us as we review how COVID-19 has reshaped disability accommodation practices, including evolving assumptions about the reasonableness of proposed accommodations and the emerging case law in this area.

Join ACC Ontario with McCarthy Tétrault as they discuss their recent successful defence of Meta (Facebook) in the Federal Court of Canada suit brought by the Privacy Commissioner of Canada. This case arose out of the Cambridge Analytica incident and is one of the most significant privacy lawsuits ever pursued in Canada. The Privacy Commissioner alleged that Meta breached Canada's federal privacy legislation by disclosing the personal information of Facebook users to third-party apps without the users' consent and by failing to safeguard that information. On April 13, the Federal Court dismissed the Privacy Commissioner’s suit, finding all allegations unproven.

The Supreme Court of the United States ruled on two affirmative action cases on June 29th - Students for Fair Admissions (SFFA) v. University of North Carolina and SFFA v. Harvard College. In each of these cases, SFFA challenged not only whether the universities’ policies comport with the Supreme Court’s 45-year precedent authorizing race-conscious admissions in higher education, but also whether that precedent should be overturned. The court ruled in favor of SFFA striking down affirmative action in college admissions.  

While the focus of these cases is college admissions, many are concerned that the implications of the rulings could have broader reach—beyond the halls of higher education and into the boardrooms and breakrooms of the nation’s corporations.  With such significant stakes, clarity on the law and the context of these cases is critical to in-house counsel’s ability to provide sound advice.  

In this webcast, held in partnership with the Lawyers’ Committee for Civil Rights under Law (which argued the University of North Carolina case in the SCOTUS), legal and diversity experts will analyze the potential impact the ruling might have on your organization and the business and corporate legal communities at-large. 

During this webcast we will be sharing benchmarking data from the ACC Foundation DEI Maturity Model and Assessment Tool (powered by Ethisphere) and the Foundation and JusticeBid's Advancing DEI Strategy with Actionable Law Firm Diversity Data Report followed by a conversation with industry leaders who will share their insights on the advancement of diversity, equity, inclusion, and belonging in the legal profession; strategies around how companies and legal departments can chart their own courses for increased DEI success; and ways in-house counsel can better influence DEI advancement in their outside counsel relationships.
