Vinson & Elkins LLP Presents: "Raising the Right Hand: Practical and Ethical Considerations When Preparing Testimony"

This CLE session is specifically designed for in-house legal departments, focusing on the unique challenges and responsibilities faced by corporate counsel when preparing company representatives to give sworn statements or testimony. The program will cover various forms of testimony, including deposition testimony, courtroom testimony, affidavits, declarations, third-party subpoenas, and other statements made under oath.

Participants will learn best practices for preparing witnesses within a corporate context, ensuring that testimony is both accurate and ethically sound. The session will address the nuances of different types of testimony and provide strategies for navigating the ethical dilemmas that may arise in a corporate setting. This CLE aims to equip in-house legal professionals with the tools needed to uphold the integrity of the legal process while effectively representing their companies.

“Optimizing the In-House Team”

Effective lawyering, operational efficiency, and business partnering are key strategic objectives for Chief Legal Officers. Which best practices lead to these outcomes? And how can CLOs and GCs demonstrate the value their team’s deliver to the organization?

Taimur Ghaznavi and David Saunders lead Konexo, Eversheds Sutherland’s consulting and alternative legal services provider. Over the last 12 years they have worked with dozens of GCs and CLOs globally, advising them on strategy, processes, target operating models, workload prioritization and technology implementations to support the optimization of their functions. Drawing on their experience working with these in-house legal teams, David and Taimur will lead over the course of lunch an interactive in-person session on optimizing the in-house team. The session will explore:

  • the characteristics and practices that most commonly lead to effective and efficient performance; and 
  • how CLOs and GCs can demonstrate the value of the in-house team to C-suite and other business stakeholders.

Recent studies have shown that there has been a dramatic increase in impairment due to alcoholism, addiction and mental health disorders among members of the legal profession. The statistics are compelling and clearly indicate that 1 out of 3 attorneys will likely have a need for substance use or mental health services at some point in their careers.

Mr. Quinn will discuss:

1. The early warning signs of impairment, with special emphasis on depression, stress and burnout.

     A. Symptoms of stress that are particularly prevalent among in house corporate counsel;

     B. Stress discussion will include the basic stress reactions, both physical and psychological; the difference between healthy stress and distress, with emphasis on the problem of gradual, incremental responsibilities, duties, pressures and demands facing corporate counsel;

     C. The transition from distress to burnout and how we can recognize and identify the sources of stress in our lives before burnout develops;

     D. Guidelines for a “master plan”, including successful time management and quick “stress busters”

2. The free services that Lawyers Assistance Programs provide to lawyers, judges, and law students.

3. A close look at what barriers exist that prevent lawyers from seeking the help they need will be provided.

4. The role that education plays in breaking the stigma and fear associated with addiction and mental illness in the legal profession.

5. How best to approach the impaired individual as well as the ethical considerations that surround a referral to a Lawyers Assistance Program.
