This Roundtable on pricing Request for Equitable Adjustments (REAs) and Claims will cover when to prepare an REA or a claim and the differences between the two, as well as the information needed and methods to properly price REAs. More specifically, it will include a discussion on pricing project delay, increased labor costs, loss of productivity, and strategies to increase the likelihood of success.  The discussion will also cover the decision-making behind submitting claims from the perspective of in-house counsel, and balancing business relationships with submitting claims. Finally, the panel will share lessons learned from their experience regarding common challenges and issues.

Please join us at The Bitter End in Greenwich Village on Thursday, November 3, 2022 for a CLE program, McCartney on Trademarks ... and Lennon Too: Key Trademark Concepts Explained Through Beatles Songs.

Kieran Doyle will lead this musical review of key trademark concepts. A full band, including Tom Kjellberg and the CLL (Cowan, Liebowitz & Latman) All-Stars, will play the Beatles tunes and the attendees will be asked to name the songs.  Then Jeni Schaeffer, Jeff Chery, Dasha Chestukhin and Kieran will explain how the songs relate to key trademark law concepts.

The Bitter End is a legendary venue where, since 1961, the likes of Bob Dylan, Stevie Wonder, Lady Gaga, Neil Young, Neil Diamond, Billy Crystal, Curtis Mayfield and Norah Jones have graced the stage. There will be music, instruction, discussion and drinks.

Bar Pro Bono Center to learn about volunteer opportunities through the Center, with a focus on clinics that in-house counsel are particularly well-suited to staff: the Brief Advice Clinics of the Nonprofit and Small Business Legal Assistance Programs. The Small Business Legal Assistance Program provides brief legal information to small business owners and prospective entrepreneurs who operate in economically disadvantaged areas or who have limited financial resources, and the Nonprofit Legal Assistance Program provides legal assistance to the District of Columbia’s community-based nonprofits. Volunteer attorneys make a one-time commitment to assist a client by helping review legal documents or answering questions about forming a business or nonprofit, taxation, real estate, employment law, or other legal issues common to these organizations. Representatives from the Pro Bono Center will share more about how you can get involved in these clinics. They will also describe the other volunteer opportunities at the Center to assist low-income residents of D.C. with legal questions in the areas of landlord/tenant, housing, public benefits, immigration, and other matters. This will offer offer a preview of the virtual Small Business Brief Advice Legal Clinic that ACC NCR and the Pro Bono Center are hosting on November 16 between 9:30 AM and 12:00 PM. Please join our experienced panel of government contracts practitioners in exploring the multi-faceted intellectual property challenges that arise when doing business with the U.S. Government. This panel will discuss a hypothetical case study highlighting key considerations to preserve your intellectual property and critical issues in government contracting data rights generally, including a discussion of relevant case law. Through this case study, the panel will discuss strategic considerations involving:

·  Differences in data rights when doing business with civilian and DoD agencies

·  Risks and benefits of Independent Research & Development (IR&D) under government contracts

·  Completing the identification and assertion of Limited Rights Chart

·  Addressing disputes when the government claims broader rights than asserted

·  Negotiating special data rights/Section H clauses and data rights in subcontracts
