E-mails and other electronic correspondence have long been problematic pieces of evidence for a litigator – both from the sheer size of electronic document productions and the potential for harmful admissions. This program will provide an overview of considerations related to e-mail and other electronic correspondence such as text messages, including considerations regarding the attorney-client privilege and how best to avoid putting damaging information into writing.

Crafting a meaningful outside counsel diversity initiative: We know we should, we’re just not sure how
It’s nearly universally accepted that in-house law departments can have a meaningful impact in how their outside law firms prioritize diversity and inclusion among the lawyers assigned to matters. Less universally understood is how to achieve that impact. In fact, recent research from the Thomson Reuters Institute shows that more than half of law departments have yet to implement a diversity initiative with outside counsel, and even those who have do not fully understand how to leverage the data they collect from their law firms.
This session will explore the findings of the research, as well as a case study of one company whose diversity program has won recognition, while also providing examples of steps others can follow to start down the path toward driving results. The session will also explore some of the more common stumbling blocks general counsel might experience in trying to implement such an initiative and how to navigate past them.

The Supreme Court’s decision to end constitutionally protected abortion rights and the state activity since that decision have significant implications for employers and the benefit plans they offer to their employees.
