With the recent high-profile insolvencies in banking and other industries, it’s essential for companies to have disciplined processes and contractual protections in place in the event of financial distress with a supplier, customer or other critical party.  We will discuss rights, remedies and practical strategies from a bankruptcy and collections perspective to ensure adherence to payment terms and mitigate delinquencies.

Presented by Mike Zito and Mark Moedritzer, Partners at Shook, Hardy & Bacon’s Commercial Recovery and Creditors’ Rights Group and Margaret Hackbarth, Assistant General Counsel, Real Estate at Constellation.

1.5 Hours of VA MCLE pending.

Employers are turning to technology at warp speed, to enhance the efficiency of various personnel processes, minimize cost, and reach decisions more quickly.  Whether utilizing selection devices that rely on artificial intelligence, including machine learning, to make initial selection decisions or mining their own data to run predictive attrition analyses, employers are relying on technology to inform or even drive their human resources practices.  Against this backdrop, regulators at the national, state and local level are wrestling with how to regulate such use of technology to ensure the absence of algorithmic bias or other forms of discrimination.

In this session, we will explore the current landscape and emerging statutory schemes, including the New York City law regulating the use of “Automated Employment Decision Tools” and parallel efforts underway in California, that will govern the use of such technology.  We will also discuss the real-life, litigation-related impacts of the move to greater reliance on technology in the workplace.

Presented by Kris Meade and Trina Fairley Barlow, Partners and Jillian Ambrose, Counsel at Crowell and Moring and Bart Barre, Assistant General Counsel, Labor and Employment Law at Northrop Grumman Corporation.

2.0 Hours of VA MCLE pending.

Microaggressions are commonplace daily verbal, behavioral or environmental slights, whether intentional or unintentional, that communicate hostile, derogatory, or negative attitudes toward socially or culturally marginalized groups. Despite the prefix, microaggressions are not inconsequential. They matter because, in order to empower your colleagues and be an effective DEI ally, you must build relationships at the individual level. And, to do that, you need to be aware of the impact these messages are having on someone else, as they often indicate your unconscious biases and leave the other person feeling excluded and devalued.

In this workshop, we will learn to identify microaggressions and recognize how they show up. Our panelists will discuss their experiences with these communications and incidents, how they have learned to react, and how they’ve learned to redirect the speaker and engaged their allies to be interrupters. We then will have small-group discussions in breakout rooms so that attendees may discuss their experiences, the tactics they have employed to address microaggressions, and what they heard in this session.

This program is presented by the DEI Leadership Development Subcommittee.
