Wellness products are an ever-growing sector of the economy, particularly with the growth of wearable medical tech, AI, and ever-more technical supplements and beauty products. How these products are designed, labeled, or marketed has enormous impacts on their legal risk.
This presentation will discuss the evolving regulatory challenges that companies must navigate when marketing such products. It provides insight into the FDA’s enforcement approach to products that straddle the regulatory divide between personal electronics and devices, or between drugs and supplements / cosmetics. The presentation also explores the recent explosion in class action litigation for false, misleading, or unfair marketing over these nuanced product category distinctions.
