Lower federal courts are grappling with the application of recent Supreme Court holdings in the context of agency deference and/or authority, and federal environmental enforcement trends and planned rulemaking continue to evolve as the second Trump Administration progresses with its deregulatory agenda. This presentation will offer a timely examination of lower court applications of Loper Bright, Jarkesy, and Seven County, as well as relevant federal enforcement updates and planned rulemaking under EPA’s Unified Agenda.
