This presentation provides a comprehensive, practical guide to navigating the critical pre-litigation phase of IP disputes — covering everything from the correspondence that almost always precedes litigation, whether in the form of cease-and-desist letters or licensing demands, to the strategic and tactical considerations involved in both sending and responding to such correspondence, including timing, pre-drafting needs, risk identification, and client expectation management, as well as detailed guidance on drafting the correspondence itself — including form, tone, length, vetting of facts and law, crafting the demand, and addressing evidence preservation obligations — all viewed through the dual lens of in-house and outside counsel.
