The privacy landscape in 2025 was shaped by significant enforcement actions, new trends in privacy-related litigation, and updates to privacy regulations. This CLE presentation, hosted by Gunster, will address:

  • The current state of privacy laws and regulations (federal, state, global, and industry) and our predictions for 2026
  • Tips for analyzing privacy laws to determine application to your organization
  • Suggestions for acting on provisions common to most privacy laws (notices, assessments, methods to exercise rights, transparency regarding sharing)
  • Practical and pragmatic strategies for compliance, such as:
    • Evaluating privacy notices and policies for compliance
    • Conducting assessments such as the heightened risk assessments required by some states
    • Analyzing online tools for marketing and tracking tools (e.g., cookies, pixels, chat bots) that may require notification or consent
    • Establishing workflows to allow individuals to exercise their rights
    • Analyzing third-party contract provisions related to data sharing, joint marketing, and cross border transfers
