Power to the IP Holder: Using “Schedule A” Litigation and Other Enforcement Tools to Stop Foreign Infringers
Many successful U.S. consumer product companies are seeing increasing foreign sellers on online marketplaces selling counterfeit or infringing products to U.S. customers. Our presenters will discuss various measures and actions that can be taken to enforce intellectual property rights (trademarks, copyrights, trade dress, design patents, and utility patents) against foreign sellers, including “Schedule A” litigation, other district court litigation, ITC actions, and the online marketplaces’ enforcement portals.
Presenters:
Brian Arnold - Assistant General Counsel and Head of Intellectual Property, Hyperice
Marko Zoretic – Litigation Partner at Knobbe Martens
Peace, Love, and Double-edged Contract Clauses
Our presenters will discuss boilerplate and other clauses commonly found in IP/technology agreements and other contracts that may appear harmless but can give rise to unintended liability and consequences. Attendees will learn how to spot these clauses with double-edged implications and negotiate them strategically to best position their client.
Presenters:
Somath Hasina – Associate Corporate Counsel Earth Friendly Products
Linda Liu – Partner at Knobbe Martens
Moderator:
Jared Bunker – Litigation Partner at Knobbe Martens
