Overview (Program Summary)

The DrewTech team will give a webinar discussing the appropriate response to a cybersecurity incident which has affected entities in multiple jurisdictions including Singapore. The webinar will take a form of an interactive table top exercise which simulates a real-world scenario based on our extensive experience in incident response. We will touch on various issues to consider at different stages of incident response, including:

 

(a) privilege issues which may arise when engaging forensic experts,

(b) reporting obligations, and

(c) considerations vis-à-vis customers and counterparties.

 

The scenario will address organisations who operate across multiple jurisdictions and the issues that may arise if it is necessary to coordinate incident response across various jurisdictions (and how counsel may assist with this) beyond Singapore.

 

The target audience would primarily be inhouse legal counsel and their role in dealing with a cyber incident to reduce risk. It may to a lesser extent also be useful for a company’s head of IT to attend so that they are able to understand the legal implications of actions that may be taken during a cyber incident.


Speakers

Rakesh Kirpalani, Director, Drew & Napier LLC

Rakesh Kirpalani is the Chief Technology Officer at Drew & Napier LLC and leads the Dispute Resolution & Information Technology team (DrewTech). The DrewTech team has extensive experience in dealing with issues where risk and technology interface, including risk management and disputes in connection with information technology infrastructure and electronic evidence. These include cloud computing contracts, Business Applications as a Service (BAaaS) contracts, wide-area network deployment contracts and over-the-top platform deployment contracts as well as data breach pre-emption and response, issues concerning the Cybersecurity Act, Personal Data Protection Act and breaches of end-user/employee confidentiality obligations.

 

With his legal and technical knowledge, Rakesh simplifies tech issues for clients, judges and arbitrators. He has advised various multi-national corporations, multi-jurisdictional private equity funds and listed companies both in Singapore and other jurisdictions.

 

Rakesh also has an active practice in commercial dispute resolution and litigation, in particular shareholders’ and directors’ disputes, economic torts, employment disputes, and disputes concerning breaches of confidentiality. He also sits as arbitrator in disputes concerning technology.

 

Timothy Oen, Associate Director, Drew & Napier LLC

Timothy is an Associate Director with the DrewTech team. His practice is mainly in commercial litigation and arbitration with a focus on information technology, and he regularly assists clients in disputes and disputes avoidance concerning commercial contracts (including provision of software services and payment processing services), incident response, and employment issues. The clients he advises and has advised includes both multi-national corporations and SMEs, financial institutions, and private clients both in Singapore and other jurisdictions.

 

Yvette Anthony, Director, Employment Legal, Asia-Pacific, Western Digital

Yvette Anthony is Director, Employment Legal, Asia-Pacific at Western Digital, where she advises on employment and workforce-related legal matters across multiple jurisdictions. In addition to her regional employment portfolio, Yvette collaborates closely with cross-functional teams on data protection, privacy, and compliance issues, bringing a pragmatic approach to incident management and regulatory risk.

A Singapore-qualified lawyer with over 15 years of in-house and private practice experience, Yvette also holds the CIPP/A certification and has a strong interest in the intersection of data protection, workplace investigations, and compliance strategy.
