Overview (Program Summary)

ACC NortheastFederal agencies are changing their enforcement approach. There is a significant increase in the possibility that companies will have in-person contact with federal agents, whether directed at the organization, its employees, or its customers.
At the same time, there has been a rise in individuals posing as law enforcement to defraud companies. To assist corporate counsel in planning for such contact, Kathleen Hamann, the head of Pierce Atwood’s Government Investigations and Corporate Compliance team, will provide practical advice on preparing for potential visits, assessing demands, and minimizing risks and disruption to company operations.

- The current state of play – why enforcement might visit you;
- Agents on site - preparing locations for potential visits:
- Public vs. private areas and the “plain view” exception;
- Verifying search warrants for accuracy and limitations;
- Arrests and searches incident to arrest.
- Assessing document demands, including administrative, civil, and grand jury subpoenas and the differences;
- Spotting fakes;
- Video and audio recording;
- De-escalation and safety considerations.
