Overview (Program Summary)

The presentation will provide an overview of key legal and regulatory considerations in health care contracting.  We will cover essential topics such as the Federal Anti-Kickback Statute (AKS), Stark Law, False Claims Act, and HIPAA, emphasizing the importance of compliance, fair market value, and commercially reasonable arrangements.  We will discuss health care regulatory implications, common pitfalls, and best practices, including standard terms and key provisions/considerations necessary for navigating the highly regulated health care industry.  Finally, we will discuss the application of these concepts in vendor/supply chain agreements, reviewing the specific fraud and abuse implications, applicable safe harbors, common arrangements, and some examples of problematic terms/arrangements.
