AZA Presents: Better Call...AI? How In-House Counsel Can Keep Outside Counsel Out of Trouble

Artificial intelligence offers powerful tools for lawyers, but it also introduces ethical pitfalls that in-house counsel must anticipate. This program will explore issues such as fake or AI-generated case citations, inadvertent disclosure of confidential client information, and the importance of clear engagement agreements as they relate to AI. Attendees will gain practical strategies for guiding outside counsel to harness AI responsibly while avoiding professional responsibility violations. By examining real-world scenarios and emerging best practices, participants will leave better equipped to uphold their ethical duties in a rapidly evolving legal landscape.

One hour of Texas MCLE Ethics Credit is Approved for this presentation.

Ahmad, Zavitsanos & Mensing, or AZA, is first and foremost a trial firm. Our more than 60 lawyers have been in a trial nearly every month since 2016. We tried 23 cases total in the years 2018 and 2019. In 2020, when many courts were closed because of COVID-19, we tried six cases. In 2021 and 2022 we tried 27 total. We tried 21 cases in 2023 and 18 cases in 2024. We have already tried 12 cases in 2025. Our courtroom experience, our knowledge of what will matter to a jury or judge, and our command of trial technology permit us to do this efficiently. Being trial-ready also strongly influences settlement. Opponents recognize that with more than 250 trials under our belts, we have confidence in our position and our ability to advocate that position. In fact, AZA is often hired on the eve of trial, once it has become clear that the case must be tried.
