LKQ One Year Later: What’s New With Design Patents?
In LKQ v. GM, the Federal Circuit, sitting en banc, overruled the long-standing Rosen-Durling framework for assessing the obviousness of design patents, adopting what the Court said was a “more flexible approach” to obviousness. Please join Fish & Richardson for a discussion of design patents, why they matter, and how things have (and have not) changed in design patent law in the year since LKQ. Our hosts will cover the following topics:

  • Substantive legal developments
  • Enforcement trends
  • Prosecution and post-grant trends
