“The Pro Se AI Litigant”
As access to generative AI tools become readily available to individuals, the use of AI is being used more often by pro se litigants to prepare arguments and draft complaints, motions, and demands. With the use of these tools by pro se litigants there are increased concerns over frivolous filings and reliance on hallucinations (citations to non-existent case law or statutes). Lawyers will need to be prepared to recognize the use of AI by pro se litigants, explain to clients the use and challenges of this technology, and respond to frivolous arguments and citations. Courts will need to consider whether pro se litigants who use AI for legal pleadings and arguments are subject to ethical rules.
