ACC GeorgiaThe ACC Georgia Chapter and Majmudar & Partners will present “Contracting in India”. This presentation will cover nuances relating to the execution of commercial contracts with an Indian party, and will touch upon key issues on confidentiality, protection of intellectual property, restrictive covenants, anti-corruption, limitation of liability, indemnification and damages. We will cover aspects for assessment of suitable governing laws and dispute resolution mechanisms for such contracts. Further, we will also discuss the execution formalities for contracts in India, including, stamp duty, registration and electronic execution. Lastly, we will discuss the importance of having comprehensive employment contracts with Indian employees and key managerial personnel.
Speakers
Rukshad Davar is a Partner and Head of the M&A practice group at Majmudar & Partners, International Lawyers; an Advocate and Solicitor admitted in India, England and Wales. Rukshad is also a Chartered Accountant admitted in India. Rukshad has over 23 years of experience in M&A, Inbound Investments, Restructurings, Joint Ventures, Corporate/Commercial, Competition/Anti-Trust and Direct Tax matters, and has successfully led and advised on complex domestic and cross-border mergers, acquisitions, restructurings, joint ventures, strategic investments, asset sales and purchases, slump sales and hive-offs, corporate advisory and direct tax and tax treaty matters. Rukshad's practice is largely international focused given his prior work experience with Jones Day, and he continues to represent several international clients on their legal matters in India, as well as he represents domestic clients.
