"E-Discovery Update"

This presentation will provide a year in review encapsulating notable developments in the field of e-discovery that occurred in 2022 and that may impact Ohio companies. Through analysis of recent case studies, the presentation will touch on key issues relating to document retention and preservation, document review and production, and management of electronic data.

"Legislative and Judicial Update"

This presentation will provide an update on changes at the Ohio Supreme Court following the November 2022 election. Three seats on the Ohio Supreme Court were up in competitive partisan elections, including a race for Chief Justice, and Republican candidates won all three, which gave Governor DeWine the opportunity to appoint a new Justice to occupy Justice Kennedy’s seat upon her transition to Chief Justice. The presentation will offer insights into how the new make-up of the Court may impact its jurisprudence and Ohio law, including specific cases and issues to watch for in 2023 that may impact Ohio companies.

The presentation will also provide an update on developments at the Ohio General Assembly, specifically on bills passed or proposed during the General Assembly’s lame-duck session in late 2022. The lame-duck session typically brings a flurry of legislative activity as lawmakers returning to the capital after the election prepare for the end of the General Assembly’s two-year session in December. The presentation will focus on legislation of interest to Ohio companies.

"Non-Compete Update"

This presentation will provide an update on recent developments in state and federal law pertaining to non-compete and no-poaching/wage-fixing agreements. Employee non-compete agreements have historically been a powerful tool for businesses to prevent their workers from unfairly competing with the business following resignation or termination. But non-competes have come under fire in recent years by a constantly evolving patchwork of state laws designed to limit their applicability and enforceability, and developments at the federal level also signal that greater scrutiny and regulation of non-competes is on the horizon. We will explore these developments at the state and federal level and offer practical guidance on how to navigate the increasingly complex maze of regulation from the employer’s perspective. 
A related and fast-developing area of competition law pertains to no-poach/wage-fixing agreements, in which two or more employers agree not to solicit one another’s employees, agree to fix wages for their employees, or share wage-related information in a way that leads to parallel behavior. The Department of Justice and the Federal Trade Commission have made such conduct a focus of their civil and criminal enforcement efforts since the DOJ and FTC jointly issued antitrust guidance for HR professionals in 2016. This presentation will provide an update on developments since the 2016 guidance, including how the Biden administration has approached these issues, some notable cases brought by the DOJ and FTC, and the evolution of legal theories underlying these cases. The presentation will also offer practical suggestions for employers to ensure they are staying in compliance with the current state of the law.
