Uyghur Forced Labor Prevention Act: Implementation and Enforcement Update

The Uyghur Forced Labor Prevention Act (UFLPA) went into effect on June 21, 2022, and companies have been grappling with how to quickly implement new practices and procedures to ensure their imported goods comply with the new legislation and are allowed entry into the U.S. Both U.S. Customs and Border Protection (CBP) and Department of Homeland Security issued guidance documents in June to assist importers in understanding some of the types of information that the government will require if an importer argues that its goods were not made with forced labor. CBP has been actively detaining goods under the UFLPA and, to date, importers have largely been unable to provide CBP with sufficient information to obtain release of their goods.
