Session I, From the Courtroom to Russia: Navigating Conflict and Industry Uncertainty

Whether navigating conflict in the courtroom or the Russia-Ukraine conflict happening halfway around the world, counsel at healthcare, biotech and pharmaceutical companies are required to navigate difficult situations just about everywhere you look.  We will discuss the current issues associated with continuing to do business in Russia in light of the war in the Ukraine.  We will also discuss two recent cases in the pharmaceutical sector to highlight how to use experts in mediations to drive better settlements and when and how to put the government “on trial” to obtain a declination or more favorable resolution.

Session II, Surprise Billing and Price Transparency: A New Era

Shifting the $1 trillion dollar hospital industry from confidential payer contracts to publicly published pricing is a massive transformation. New CMS hospital price transparency requirements implicate public relations and business strategy issues, yielding a wide range of hospital and health system approaches to reporting the required data. As compliance increases, we are entering a world of publicly visible payer contracts which affect everything from negotiation strategies to value-based care. In this session, we will discuss the specific regulatory requirements to report hospital pricing data, the risk of partial compliance, CMS penalties and the implication of pricing transparency on confidentiality clauses in payer contracts. We will also review a sample of Philadelphia-area pricing data and what this change means for payer negotiations, value-based care, pricing strategy, and other business issues.
