Europe Update: Consumer Law is the New GDPR

Is your European subsidiary ready for the current overhaul of consumer protection regulation in the EU and the UK called the 'New Deal For Consumers'? A series of new rules, some in force since January 2022 and others coming into force over the course of the summer, will reshape consumer contract law for "smart products" and digital goods and services across Europe. Businesses will need to update their terms of sale to reflect mandatory warranties and on-going update obligations, incorporate the new concept of "payment with data", and provide more and different mandatory information to consumers. Enforcement will be enhanced, including GDPR-style fines based on annual revenue. Speaking of the GDPR, there have also been some developments on how data can be shared between European and US entities. The panel will provide an overview of the new EU rules as well as some local specifics in important markets like Germany, and offer practical advice on what businesses should do now to implement the new laws.
