Communicate, Investigate, and Calculate for the Highest Property Loss Recovery

This presentation will explore the anatomy of a claim for property loss recovery, whether it be a commercial loss, cargo loss or damages, or recovery from a claim like workers’ compensation fraud.  Representing businesses in their day to day legal needs, in house litigation counsel are very often on the defensive side, however, these types of claims require work on the offensive, as a plaintiff, to recover that which rightfully belongs to the company.  This requires a mindset shift and different strategies to be successful.  We will discuss key pieces of information that must be gathered at the outset to build out a solid claim file and strategies to employ to help ensure recovery is achieved and the business is made whole. We will share real world examples illustrating best practices and provide a roadmap for in house counsel to provide substantial value to the business through its ability to efficiently manage these claims.

At Long Last: U.S. Federal Privacy Legislation On the Horizon

On June 3, 2022, a bipartisan draft bill was released by key Congressional leaders that represented a decades-long effort to achieve consensus on a federal data privacy law that would provide a national standard as to what kind of data business organizations may gather from individuals and how those organizations may use it. The finish line is yet to be crossed – but lawmakers are close. If this draft bill becomes law, the American Data Privacy and Protection Act (“ADPPA”) would provide a federal roadmap as to how all businesses must operate around the collection and use of individual Americans’ data.
