ACC National Capital RegionThe modern workplace presents a continually evolving array of ethical issues for in-house counsel. The area of employment law has long been rife with ethical questions, which can only become more complex with the advent of remote and hybrid workplaces. Be prepared to identify and evaluate these challenges early and know how the Virginia Rules of Professional Responsibility apply. We will also examine where and when the Virginia Rules depart from the Model Rules.
This program will explore the ethical landmines waiting in workplace investigations, litigation discovery and related document issues, employee use of social media, employee monitoring, and other challenges presented by remote and hybrid workplaces. We will also examine issues relating to the representation of multiple interests, former employees, and strategies for what to do when things go wrong.
