ACC National Capital RegionSince the U.S. Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization, employers have been considering how the decision and resulting state legislative activity impact their health plans. What, if anything, should employers be considering regarding access to reproductive services for plan participants? We will discuss the state of the current legal landscape, including recent executive and potential regulatory action, highlight key considerations including ERISA preemption of state laws and share evolving design options for employer-sponsored benefits.
