The Government’s focus on strengthening the effectiveness of the unfair contract term regime is continuing and civil penalties will be shortly introduced. Further changes also include expanding the ‘small business’ threshold, and including a rebuttable presumption against the use of terms previously found unfair in similar circumstances.

This important session, presented by Gilbert + Tobin’s Technology + Digital and Competition + Regulation teams, will cover the spectrum of relevant compliance considerations by providing practical tips for the negotiating and drafting of terms, through to insights gained from previous ACCC investigations.

Tim Gole

Tim Gole, Partner, Technology + Digital
Tim is the head of the firm’s Technology + Digital group, and sits on the Board of Gilbert + Tobin.  
Tim focuses on technology, media, telecommunications, broadcasting, payment systems and digital (e.g. data) transactions, as well as associated regulatory areas such as consumer law and privacy.  Tim also often works on complex and bespoke commercial arrangements generally. Tim also advises on a number of related regulatory areas, such as those relating to consumer law, and privacy and data.

 

Charles Coorey

Charles is a Partner in Gilbert + Tobin’s Competition + Regulation group.  
Charles has deep expertise advising clients on: the Australian Consumer Law including misleading or deceptive conduct, unconscionable conduct, consumer guarantees and product liability issues; competition law matters including merger clearances, joint ventures, misuse of market power matters and cartel matters; and access to infrastructure under Part IIIA of the Competition and Consumer Act including declaration applications and access undertakings.
