Data breaches are now a key risk for all Australian businesses. Australia’s data breach regulatory regime is unique as is its continuous disclosure and class action environment.  This combination poses distinctive and developing challenges for companies and boards in preparing for, and managing, these issues as they arise.  

This webinar, presented by Gilbert + Tobin’s Corporate Advisory and Intellectual Property teams, will explore:

  • the data breach regime and how it intersects with directors’ duties, the current continuous disclosure obligations and regulatory and class action risk; 
  • recent high-profile cases; and 
  • how this might be impacted by law reform proposals to introduce a permanent knowledge element for civil liability for breaches of the continuous disclosure regime.

Rebecca Dunn

Rebecca Dunn, Partner, Technology + Digital

Rebecca is a partner in Gilbert + Tobin’s Intellectual Property group. She is an IP litigator with over 15 years’ experience in copyright, data, software, social media and trade secrets disputes. 
Rebecca has also worked on substantial cyber breach investigations, notifiable breach scenarios, privacy law compliance and disputes concerning liability for cyber breaches. She has run a number of investigations into data breaches following cyber-attacks on major Australian companies, including those leading to the first notifications to the Privacy Commissioner following the introduction of the Notifiable Data Breach scheme under the Privacy Act in 2018. 

 

Tim Gordon

Tim Gordon, Partner, Corporate Advisory

Tim advises listed and unlisted companies and Australian and offshore private equity fund managers in relation to mergers and acquisitions, capital raisings, joint ventures, corporate restructurings and recapitalisations, business and share sale processes and regulatory investigations. 

Tim is a member of the Law Committee of the AICD and is a regular commentator in the media on corporate governance.
