Session I - 8:30 a.m. to 9:30 a.m. (Reed Smith) – GDPR Update on EU Data Transfer after Schrems II

Over the past year, thousands of companies have been forced to reassess and revise their international data transfer practices in an effort to comply with GDPR.  The recent Court of Justice of the European Union (CJEU) decision known as Schrems II has created an atmosphere of uncertainty and an evolving legal landscape.  The CJEU’s decision in Schrems II invalidating the Privacy Shield poses significant questions and concerns for many companies handling European personal data or otherwise doing business in Europe.  This session will address the context and history of the Schrems II decision, updated guidance from the European Data Protection Board, and top considerations for business to update approaches to cross-border data transfers.

This presentation will provide in-house attorneys and non-specialists alike with an overview and some key principles they can draw on to issue-spot and diagnose key considerations in the privacy compliance space.

Session III - 11:30 a.m. to 12:30 p.m. (Shook Hardy) - Trends in Privacy and Data Security Legislation and Litigation: What Every Corporate Counsel Must Know

Session replay litigation, biometric privacy, the impact of privacy laws on marketing analytics, the abuse of private rights of action, a shift in regulatory enforcement under the Biden administration, insuring ransomware events, and new privacy laws in 2022 are some of the privacy and data security legal trends and issues this panel will address in a lively discussion.  There will be a particular focus on how these developments are impacting companies doing business in the Delaware Valley.  Bring your questions for this panel on privacy and data security issues.
