There have been many new changes and updates at the Patent Trial and Appeal Board (PTAB) in recent months that impact both petitioners and patent owners. The panelists will present a recap of the PTAB’s latest guidance, explain the impact of the important changes in the law, and how to avoid major pitfalls.

In particular, the panel will discuss the PTAB’s Fintiv decision and other precedential/informative decisions that discuss the Fintiv factors, the changes to the PTAB’s Motion to Amend practice, and the recent rule change regarding indefiniteness. The panel will also discuss what to expect under the new leadership at the U.S. Patent and Trademark Office, and the practical and legal significance of the Federal Circuit's Arthrex decision and what to expect from the Supreme Court’s review of Arthrex.

To round out the discussion, corporate counsel will share their insights on strategic considerations for filing and defending patent challenges at the PTAB and the impact of such challenges on their businesses.
