Courts have always been wary of non-competes and other restrictive covenants for a variety of reasons, including the fact that they are often not negotiated and are viewed as “contracts of adhesion.” Now, due to the perceived overuse (some would say the abuse) of non-competes by many businesses, they are under assault by state and federal governments and regulators. The ACC Georgia Chapter welcomes Berman Fink Van Horn P.C.  whose attorney, Benjamin Fink, will present “Employer Non-Competes and Other Restrictive Covenants: Trends, Traps and Hot Topics”. This presentation will explore the state of restrictive covenant law in Georgia as well as the status of efforts around the country to regulate their use. Trends and recent developments in the related topic of trade secret protection will also be discussed. Come learn everything you need to know to protect the competitive edge of your company!

Berman Fink Van Horn is pleased to make this event available for you to participate as you prefer, whether it is in-person or via Zoom. The webinar portion will begin at 12 pm. In-person attendance is limited to 30 guests and seating will be spaced appropriately. In-person guests will be required to wear masks, except when eating or drinking. Registration to attend in-person will close when maximum count has been reached. ACC membership is open to attorneys who practice law as in-house counsel employees of organizations and who do not hold themselves out to the public for the practice of law.

A CLE credit of one (1) hour is being applied for, and if approved, will be submitted to the Georgia State Bar for attendees licensed to practice in Georgia.

Speakers

 

Benjamin Fink is a shareholder at Berman Fink Van Horn P.C. His practice focuses on business and commercial litigation with an emphasis on competition-related disputes, including non-competes and trade secrets.

Ben is a frequent guest speaker at seminars on noncompete, trade secrets and other related topics throughout Georgia and other parts of the country. He is a published author on restrictive covenants and also blogs and co-hosts podcasts on noncompete and trade secrets. Ben is a Top 100 Super Lawyer in Georgia, one of Georgia’s Legal Elite and has been selected for inclusion in the Best Lawyers in America, including being named Lawyer of the Year for Litigation – Labor and Employment in Georgia. His professional involvement includes current and past chair positions on the Trade Secrets Committee of the American Intellectual Property Law Association and the Labor and Employment Law Section Board of Directors of the Atlanta Bar Association. Ben also serves on the Sedona Conference drafting team for Protecting Trade Secrets in Litigation.  

Ben is a graduate of Emory University School of Law, where he currently serves as Emory Law Alumni Board President, and Duke University, where he serves on the Atlanta Regional Alumni Board.
