Recent cases have highlighted the trade secret risks posed to California companies in this era of employee mobility, cheap data storage, and fierce competition for employees. For example, Jawbone v. Fitbit discussed how a disaster recovery backup can lead to civil lawsuit and criminal prosecution. Waymo v. Uber showed the importance of addressing inbound and outbound employees and trade secret protection. And AMN Healthcare v. Aya Healthcare Services - highlighted the potential invalidity of employee non-solicitation and confidentiality clauses. 

These issues are heightened during the current environment of employees working from home, business deals being done over virtual platforms, and layoffs, and opportunistic hiring occurring due to the economic downturn.
