ACC Europein 2018 the EU Commission has launched a reform of the rules relevant for the assessment of vertical (distribution) restraints under EU Competition law. Although this process is to be completed in 2022, the most important changes to the Regulation 330/2010 and the Commission Guidelines on Vertical Agreements are already discussed among stakeholders. The reform introduced at the EU level will force amendments into national legislation pertaining to the assessment of vertical restraints. During our presentation we will elaborate on the most important issues discussed between the EU Commission, national competition authorities and undertakings in the context of the contemplated regulations.
Reforma reguł oceny porozumień wertykalnych (dystrybucyjnych)
w 2018 r. Komisja Europejska rozpoczęła reformę zasad dotyczących oceny porozumień wertykalnych (dystrybucyjnych) na gruncie unijnego prawa konkurencji. Jakkolwiek proces ten ma zostać zakończony w 2022 roku, już w chwili obecnej dyskutowane są najważniejsze zmiany do rozporządzenia 330/2010 oraz wytycznych Komisji w sprawie ograniczeń wertykalnych. Reforma wprowadzona na szczeblu unijnym wymusi wprowadzenie zmian do krajowych przepisów dotyczących oceny porozumień wertykalnych. W trakcie wystąpienia przedstawimy najważniejsze zagadnienia dyskutowane pomiędzy Komisją, krajowymi organami konkurencji oraz przedsiębiorcami w kontekście planowanych regulacji.
