Please join us for a panel discussion on mediation strategy for successful negotiation, with a focus on effective coordination between in-house and outside counsel.  The panel will feature Hon. Howard Matz (Ret.) and Partner Mark Drooks from Bird Marella and Joni Gaudes, VP & General Counsel of ASICS America Corporation.  The speakers will deconstruct the mediation process and answer the following critical questions/topics: 

  • What are the characteristics of effective mediation briefs?
  • Should we share mediation briefs?
  • Should we have a joint session?
  • Limits on authority
  • Tips on making opening demands and first offers
  • Effective use of brackets
  • How to leverage mediator’s proposals

Topics focusing on the role of in-house counsel will include:
