Fair Credit Reporting Act (FCRA) litigation has continued to increase as both consumers and employees challenge the adequacy of companies’ credit investigation and reporting practices. Amendments to the FCRA as part of the CARES Act have changed the obligations of furnishers of information. Employee claims under the FCRA have continued to increase, as courts grapple with the FCRA’s requirements regarding employee background checks. Over the course of this year, the Ninth Circuit has issued three seminal decisions (Walker v. Fred Meyer, Luna v. Hansen and Adkins, and Marino v. Ocwen Loan Servicing) that have provided helpful guidelines.

This webinar will provide an overview of recent developments, and identify current best practices of reducing risks of potential class action litigation under the FCRA and state statutory restrictions on credit reporting. Our speakers will identify current litigation trends, recent regulatory developments, and issues on the horizon as employers and furnishers of credit information grapple with the ever-changing requirements.
