There are various problematic situations that employers may face that must be investigated and dealt with by HR, whether this involves harassment complaints, safety issues, company policy violations, or other workplace issues. Whatever the triggering event may be, it is important that you know the steps of a proper investigation and that you have the ability to investigate complaints in a timely and meaningful way. When conducted correctly, a workplace investigation will become a valuable record to support any remedial action that you may wish to take. A poorly managed investigation can prove costly, time-consuming and disruptive to your business.
 
We have invited Christian Bayart and Inge Vanderreken, Belgian Employment & Benefits partners at Allen & Overy, to share what companies should do in order to operate a robust and clear internal investigations process. They will guide you through every step of an internal investigation, from receiving the initial allegation or complaint to dealing with the outcome of the investigation.  In particular they will discuss the following topics:

  • Triggering events: complaints, whistleblowing, internal audit, dawn raid,... 
  • Role and protection of main actors: alleged victim, accused, witnesses
  • Identity, role and duties of the (internal/external) investigator 
  • Typical subject matters: harassment, retaliation, fraud, other compliance issues 
  • Fact finding: interviews and searches
  • Constraints: privacy and data-protection issues 
  • Workplace investigation and criminal law issues: legal privilege, notification duties, interaction with public authorities, due process rules
  • Disciplining or dismissing following the outcome of an investigation
  • Investigation and settlement agreements
