This basic marketing pitch is great at encouraging consumers to pay it forward by simply purchasing your product. While this type of cause marketing can be a win-win, these activities are highly regulated. Any company looking to link consumer purchases to a donation to charity needs to be aware of very specific "commercial co-venture" statutes in many states. Brick and mortar retailers, on-line retailers and any brand who plans on running these campaigns, must plan carefully to structure a successful commercial co-venture promotion and be aware of the pitfalls of non-compliance with charitable solicitation laws and consumer protection statutes.
During this program, Verrill Dana promotions law attorney Rob Laplaca will walk attendees through cause marketing and commercial co-venture requirements for both brands and charities, from conception through execution, including mandatory contract provisions and advertising disclosures, as well as state registration and bonding requirements.
