Overview (Program Summary)

A program hosted by:

ACC National Capital Region

Please join us for a half-day conference that will address the essentials of establishing a privacy program for your company.

This practical privacy primer will provide in-house counsel the tools to establish a strong privacy and data security program.  First, learn about the key global data privacy frameworks, including GDPR, CCPA and the Canadian regulations, followed by a discussion of how to create a compliant program.  Finally, as every good program needs a contingency plan in the event of a data breach or security incident, we will establish what your incident response plan should look like and how to ensure your company has the proper insurance coverage in the event there is a breach.

Sessions:
#1: Privacy Regulatory Framework and Industry Trends.
Presented by Borden Ladner Gervais

#2: Information Governance:  Strategies for Privacy and Security Compliance
Presented by  McGuireWoods LLP

#3: Incident Response Plans and Preparedness.
Presented Baker Botts LLP

#4: Cyberinsurance:  How to Make Sure You Have the Right Coverage
Presented by  Barnes & Thornburg

Speakers

Session #1: Presented by Borden Ladner Gervais
Learn how an IG program can reduce the risk of data breaches, provide better response and remediation in the event of a security threat, and enhance your organization’s overall compliance effort. Proper management and control may also enable your organization to harness and explore the value of “big data” to accelerate revenue and reduce inefficient programs. Whether it’s day to day operations, M&A activity, or data analytics, let us show you how you can get control of your data and make it work for you.

Session #2: Presented by McGuireWoods LLP
This session will discuss the building blocks of a solid IG program, including:

  • What it means to “inventory” your data.
  • Compliance with federal, state, and industry-specific regulations and standards related to IG, data privacy and information security.
  • Key IG policies and procedures for leveraging information and reducing risk (e.g. Written Information Security Program, Incident Response Plan, Records Retention Schedule, Privacy Policy, BYOD policy, key vendor contract protections, etc.).
  • Learn how an IG program can reduce the risk of data breaches, provide better response and remediation in the event of a security threat, and enhance your organization’s overall compliance effort. Proper management and control may also enable your organization to harness and explore the value of “big data” to accelerate revenue and reduce inefficient programs.

Session #3: Presented by Baker Botts
Even the best laid plan needs a Plan B.  The focus of this program will be on how to build an incident response plan in the unfortunate event of a breach and preparing the Legal team for a response to the incident response, including:

  • How the privilege can be best utilized;
  • How to best manage communications between the in-house team and outside counsel, security team, communications, operations and the C-suite/board.

Session #4: Presented by Barnes & Thornburg
Seeing that cybercriminals have figured out new ways to get money from companies across America, will your insurance respond?  And what can you do to put your company in the best spot possible to get such matters covered?

This session will discuss coverage for ransomware events, business email compromises and wire fraud, and more.  It will address new insurance lawsuits, including litigation over whether a war exclusion applies, sub-limits reduce the total coverage available, and other updates.
