Upheaval in international trade law has generated uncertainty for importers, exporters, direct investors, and portfolio investors. This situation is manifest at all three levels at which international trade law operates – the multilateral (i.e., World Trade Organization), regional (i.e., free trade agreement), and national (i.e., U.S. and bilateral) levels. Leading examples, respectively, concern the operation of the WTO Appellate Body, the new version of the North American Free Trade Agreement, and the Section 232 cases against steel, aluminum, and autos and auto parts, and the Section 301 case against China.
Uncertainty because of Upheaval in All Three Levels (10 minutes)
Multilateral: WTO Appellate Body Cease to Function? (15 minutes)
Regional Level: To Pass, or Not to Pass, NAFTA 2.0? (15 minutes)
National Levels 1-3: Sections 232 and Section 301/ National Security Tariffs & Trade War End (20 minutes)
