Chief among the more than 1,000 bills Governor Brown signed into law in 2018 are first-in-the-country obligations on employers to prevent sex and other harassment and measures undercutting employers' ability to defend and settle harassment suits. The laws going into effect January 1, 2019, include a measure barring the use of traditional confidentiality provisions in sex harassment settlements, a statement of legislative intent that it is rarely proper to grant summary judgment in a sex harassment lawsuit, broad expansions of employer liability for harassment other than gender-based harassment, and requirements that ever more employees be given harassment prevention training, and in some circumstances provide training on human trafficking.
