Less than 2% of litigation cases in the U.S. go to trial, the rest settle or resolve short of trial. 

Many corporations are disinclined to go to trial, so their objective is not only to settle, but (hopefully) settle for the optimal outcome given the circumstances of a particular case. One might think that screening outside counsel for trial experience is a waste of time, but we have learned that the best way to settle a case favorably is not by preparing to settle, but by preparing to go to trial. Your defense counsel must demonstrate that you are ready and prepared to present a persuasive case to the jury or trier of fact. Experienced trial counsel are best situated to help you do this because they have actually prepared for and gone to trial many times, so they know what it takes to construct a real, winning (or losing) case.
