Primer for Successful Litigation Management: 10 Ways Experienced Trial Counsel Can Help Your Company Obtain an Optimal and Efficient Settlement Without Going to Trial
Less than 2% of litigation cases in the U.S. go to trial, the rest settle or resolve short of trial.
Many corporations are disinclined to go to trial, so their objective is not only to settle, but (hopefully) settle for the optimal outcome given the circumstances of a particular case. One might think that screening outside counsel for trial experience is a waste of time, but we have learned that the best way to settle a case favorably is not by preparing to settle, but by preparing to go to trial. Your defense counsel must demonstrate that you are ready and prepared to present a persuasive case to the jury or trier of fact. Experienced trial counsel are best situated to help you do this because they have actually prepared for and gone to trial many times, so they know what it takes to construct a real, winning (or losing) case.
Join the ACC Colorado Chapter for lunch and a presentation from members of the National Association of Minority and Women Owned Law Firms (NAMWOLF) Trials PAC and local counsel on how experienced trial counsel can set your case up for settlement by preparing for trial, and as a result, obtain an optimal outcome without trial.
