Anti-corruption around the globe

The Department of Justice and the Securities and Exchange Commission collected $2.89B from corporations to resolve Foreign Corrupt Practices Act (FCPA) cases in 2018, up from $1.89B in 2017. Join Sergio Leal, AGC Compliance at Bilfinger and Eversheds Sutherland Partners Jack Massey (US) and Emma Gordon (UK) for a discussion on developments and issues in the global anti-corruption regime, as well as tactics to implement both to remain compliant and to respond effectively. Specifically, topics will include: 

  • Developments in the FCPA and Bribery Act
  • The role of other states and institutions in compliance and enforcement
  • Multi-jurisdictional investigations and prosecutions including double jeopardy
  • Privacy laws that impact the transfer of data in an FCPA investigation 
  • Aspects of an effective global compliance strategy


Cross-border criminal investigations

Justin Olson, Senior Director & Chief Compliance Officer for Corporate Legal, Compliance and Risk with McDermott International and Eversheds Sutherland Partners Jim Mastracchio and Sarah Paul will discuss the current state of cross-border government investigations, how to improve compliance to help prevent an investigation and how to respond to the government if you become embroiled in an investigation. Topics covered will include: 

  • Department of Justice (DOJ) trends in cross-border corruption, sanctions and tax investigations of companies, as well as the updated DOJ corporate compliance guidelines and what they signify
  • Newly issued IRS multi-jurisdictional examination techniques
  • Treaty protections available to companies facing multi-jurisdictional investigations
  • The pros and cons of self-reporting and what it means to cooperate with the government
  • Protecting the attorney-client privilege during civil and criminal investigations
