Overview (Program Summary)
A program hosted by:
ACC San Francisco Bay AreaThe US International Trade Commission (ITC) provides an alternative forum for US patent owners to seek redress for patent infringement. The number of actions before the ITC has spiked in recent years, as patent owners look for paths to enforce their rights and protect their IP, especially after the Federal Circuit has provided further guidance on the agency's authority. Patent owners also have appreciated the ITC’s willingness to proceed with an investigation even as there are parallel challenges before the Patent Trial and Appeal Board (PTAB).
This session will cover:
-
Trends in recent ITC actions and lessons learned to protect your IP and guide enforcement strategy
Evaluating the ITC as forum for potential action, including a discussion of considerations such as expeditiousness, its broad jurisdiction, hearing before Administrative Law Judge, customs enforcement, temporary and general exclusion orders and more
Strategic and practical tips for filing a complaint in the ITC
(Networking lunch and registration opens at 11:30 AM. Program begins at noon)
