Overview (Program Summary)
Trade secret litigation in the United States has reached an inflection point: federal filings are at record levels, jury verdicts regularly exceed nine figures, and courts are simultaneously tightening the substantive and procedural requirements that plaintiffs must satisfy to prevail. This program will survey the most consequential trade secret decisions from the past year, including landmark rulings on pleading specificity, the “reasonable measures” requirement, damages apportionment, and the intersection of trade secret law with generative AI and employee mobility in the technology sector. The presentation will include practical information for in-house counsel, audience-engagement hypotheticals drawn from real disputes, and actionable guidance on onboarding and offboarding protocols to guard against the loss of trade secrets when employees separate and to minimize the risk of trade secret claims from the former employers of new hires.
