The speakers will cover the following topics:

Traffic Insurance Investigation (2017)

The Competition Board initiated an investigation against 33 companies operating in the market for Highways Motor Vehicles Compulsory Financial Liability Insurance (Traffic Insurance). The allegation was that these undertakings had engaged in anti-competitive, restrictive agreements and/or concerted practices by way of collectively increasing prices. The Board decided not to impose an administrative fine.

Coinsurance Investigation (2020)

The Board concluded the investigation where undertakings operating in the market for voluntary insurance on high-risk capacity works (including project finance) were investigated for engaging in agreements/concerted practices via exchange of competitively sensitive information such as policy conditions, prices, premiums during proposal process or prior to proposal. The Board found that several undertakings had violated Article 4 of the Competition Law in terms of open and closed coinsurance transactions. It was emphasized that in order to ensure a competitive process, it is expected from the companies to provide their offers to the customer independently. 

OSEM Investigation (2021)

The investigation initiated against OSEM Sertifikasyon A.Ş. has been terminated by the Board with the acceptance of the following commitments in order to address competitive concerns:

a.      Divestiture of OSEM’s shares

b.      Termination of the protocol foreseeing information exchange

c.      Only one insurance company to have BoD/high level management seat in OSEM

d.      Not to use information gathered as a result of BoD/management position to gain advantage

e.      To give an OSEM certificate to auto repair maintenance services and explain that OSEM certificate is not mandatory for damage repair services

HR Investigations (2021-2022)

Prevention of employee transfers between undertakings through direct and indirect agreements may deprive employees of job opportunities that offer higher wages and better conditions. Thus, the competitive structure in the labour market may be damaged by the decrease in the mobility of labour among companies and the artificial inability to find the real value of the wages in return for the labour. In this context the Competition Authority has three recent investigations on “no-poach practices”.

  • The Competition Authority has initially initiated an investigation against 32 undertakings due to an alleged gentleman's (no poaching) agreements regarding the labour market, which was then been expanded to encompass 48 undertakings.
  • The Competition Authority ruled that some private hospitals violated the Competition Law by determining prices for private practitioners operating room usage as well as for certain operations and report approvals, implementing gentleman's agreements to prevent the transfer of doctors from one institution to another and by determining the minimum and maximum rate of the salary increase of the employees. The Board thus imposed an administrative fine of 58 million TL.
  • On 9 May 2022 another investigation was launched against 7 undertakings operating in the technology sector for using gentleman's agreements in the labour market.
