Negotiating the Most Important Terms: evolving developments in the way you look at your contracting strategy
 
In-house lawyers are continually analysing agreements and leading negotiations across a range of different legal areas. In this presentation Piper Alderman's Martin Lovell, John Doyle and Juniper Watson will touch upon how you might approach reviewing, analysing and negotiating the most negotiated and important terms in your agreements. 
 
This interactive and informative panel style presentation (where questions are very much encouraged) will:
 
•    outline the global, Australian and industry trends in negotiated terms;
•    consider why those terms are negotiated more than others;
•    identify and approach Owner/Principal/Vendor or Contractor/Supplier/Purchaser focussed terms and what the “middle ground” might look like; 
•    discuss what terms are overlooked and should be given closer attention; and
•    provide suggestions as to what you should be looking out for in your agreements.

Martin Lovell, Partner  - Piper Alderman
 

Martin is a leading projects, infrastructure and finance lawyer and national head of the firm’s Projects and Construction practice team.
 
Martin regularly advises developers, government and contractors in relation to major infrastructure and energy projects, joint ventures and business structuring. He also advises sponsors and financial institutions on project finance and development transactions.
 
Recently, Martin has acted on the development, acquisition and funding of large scale grid-connected battery projects, wind and solar farms, district energy schemes, resources projects, ports, gas pipelines and water and electricity transmission infrastructure.
 
Martin is highly regarded for his technical skills, including his expertise in Personal Property Securities law and trusts law. He is a member of the Financial Services Committee of the Law Council of Australia and holds a Master of Law with first class honours from the University of Cambridge. Martin also lectures at Flinders University and is a regular contributor to Thomson Reuters, LexisNexis and other legal publications.
 
John Doyle, Partner - Piper Alderman
 
John is a leading projects, energy, infrastructure and engineering services lawyer in the firm’s Projects and Construction practice team.
 
John has gained significant experience both in Australia and the UK in the delivery of major infrastructure projects across a range of industries, with particular expertise in the mining, electricity, utilities and infrastructure sectors. Prior to joining Piper Alderman, John spent 10 years in senior in-house legal positions for significant construction and energy companies delivering major projects across Australia.
 
John has recognised proficiency in the preparation and negotiation of connection agreements, supply arrangements, construction related agreements including EPC, design and construction, procurement, equipment supply contracts, operation and maintenance agreements, ECI, alliance and partnering arrangements and other related project documents.
 
He advises on all aspects of project delivery from project planning and strategy, project structuring and procurement options, risk assessment and allocation, tendering and bid preparation and assessment, contract preparation, negotiation and administration.
 
John has a strong track record of advising developers, project owners, contractors and in-house legal teams to assist them to deliver pragmatic and solution focused outcomes.
 
Juniper Watson, Senior Associate  - Piper Alderman
 
Juniper is a commercial lawyer and has worked with Piper Alderman since her admission in February 2007. Juniper’s practice incorporates the commercial negotiation and documentation of infrastructure and capital projects, and she is experienced in avoiding and managing disputes arising out of those contracts.  This experience enables her to provide a continuity of service throughout the life of construction and infrastructure projects – from procurement to completion.
 
Juniper has experience working for clients within defence and who contract with defence. Juniper provides sound commercial advice regarding contractual, statutory and common law obligations and liability. Juniper has advised regarding supply agreements, insurance policies, security enforcement and enforcement of judgments.
 
Juniper completed a Master of Laws through the University of Melbourne. This further study complimented her practical experience and served to further develop Juniper’s specialist legal knowledge. Her conscientious approach ensures that she communicates in a comprehensible and timely manner, alive to commercial consequences and proportionate to the risks and exposures involved.
