Title: Employment Law Update with Bressler, Amery & Ross, P.C.

  • Section 1: Political Expression in the Workplace: Dos and Don’ts Employers Need to Know
    • 2020 has been a year of protests and political unrest. Employees often want to express their political and social opinions in the workplace. How employers can and should respond has become a hot topic and the basis of employee lawsuits. We will examine what employers can and can’t do and also discuss some best practices.

  • Section 2: Managing Your Workforce During a Pandemic: Telework, Return to Work, Wage & Hour, and Privacy Pitfalls
    • COVID-19 has created numerous challenges for employers that will continue after business re-open.  Our team will identify these potential perils – including telework accommodations, privacy and compensation issues for remote workers and return to work issues--  and provide best practices for navigating the bumpy road ahead as we all embrace the “new normal” in the workplace.

  • Section 3: Navigating the Legal Landscape after Bostock v. Clayton County, Georgia:  Workplace Protections for LGBTQ Employees
    • The central holding of the Supreme Court's Bostock decision was widely expected, but some employers were unprepared for its ramifications. Are your policies and procedures up to snuff? Are your managers and employees properly trained? Is your company ready for people to be more open about their sexual orientation or gender identity at work? Let's discuss steps you can take to avoid litigation and advance a positive and inclusive workplace.  

Speakers

Rima Hartman’s practice focuses on labor and employment law. Rima defends employers against claims brought by employees, including claims of discrimination, harassment, and retaliation under Title VII of the Civil Rights Act, the Americans with Disabilities Act, and the Age Discrimination in Employment Act. She also litigates claims under the Family and Medical Leave Act, cases involving accommodation issues, and wage and hour disputes arising under the Fair Labor Standards Act. In addition, Rima handles arbitrations and administrative proceedings before the EEOC and its state counterparts. Rima regularly counsels clients on day-to-day employment matters, including conducting investigations, drafting employee handbooks, reviewing employee classification systems, and providing management and employee training.

Carole Miller serves as Co-chair of Bressler’s Labor and Employment practice, and is a member of the firm's Executive Committee. She practices exclusively in the area of labor and employment law.  Throughout her twenty-five years of practice, Carole has represented employers with regard to the full spectrum of employment claims, with a particular focus in the financial services industry.  Her employment practice is national in scope.  She has litigated claims pending in more than thirty states and regularly appears before FINRA, AAA and JAMS with respect to employment-related matters brought against brokerage firms and other financial services firms and institutions. 

Mathew Penfield advises and represents clients in the areas of immigration, labor and employment, and general litigation. He counsels and represents employers with all their immigration needs, assisting with employment-based visas and navigating the maze of federal and state immigration law compliance. His litigation experience includes trying cases in federal and state courts and arbitration forums.  Matthew's employment practice includes representing and advising clients in a wide variety of employment matters, including employment and non-compete agreements, contract disputes, and discrimination and retaliation cases arising under federal and state discrimination and tort laws. He also has experience defending both individual and class and collective action lawsuits brought by or on behalf of current and former employees.

For more than twenty years, Stuart Roberts has helped employers solve problems arising in the workplace, both as a litigator and counselor.  Stuart’s primary experience is defending lawsuits and arbitration claims brought by employees under federal and state discrimination laws wage and hour laws, whistleblower statutes and many other laws that govern the employment relationship. Stuart also guides employers through employee discipline/termination issues, crafts employment policies, handbooks and agreements for key employees and respond to federal and state audits by OSHA, the Department of Labor, the OFCCP and other government enforcement agencies.
