ACC KentuckyWhile receipt of payment for services performed or goods delivered during the pandemic may seem like a relief, it is still not without risks for unsecured creditors. Join Dinsmore attorneys Sarah Mattingly and Lira Johnson to learn (or refresh your memory on):
- Why it is important to require payment in and through the ordinary course of business (even during a pandemic), and
- The risks associated when receiving payments from a customer who ultimately files bankruptcy or is placed in receivership.
Examples include situations where the unsecured creditor may have to hand over payments received to a bankruptcy trustee or receiver. Attendees will also learn basic steps for dealing with a bankruptcy filing by a customer and discuss effective record-keeping practices to maximize their businesses’ potential to retain pre-bankruptcy petition payments.
