Employers Beware: A Speed Round of Trending Topics

Presenters will deliver a fast paced break-down of new issues, recent developments, risks and enforcement trends that impact your company today. From an employment and privacy perspective, these highlights will resonate with in-house counsel in all industries - multiple compelling issues wrapped into one hour long session.

Does Title VII's ban on "sex" discrimination prohibit discrimination on the basis of "sexual orientation?"

The United States Supreme Court will consider three cases that ask whether federal anti-discrimination laws should apply to sexual orientation and gender identity in the workplace. Two of the cases were consolidated because both include claims that employers discriminated on the basis of sexual orientation. The third  involves the question of whether existing discrimination laws apply to transgender workers. The court’s decision to take up these cases could resolve the existing circuit split on the issue and, hopefully, will provide employers clarity on the issue.

Picking and Prepping a Proper Corporate Rep Witness

Whether your company is the Plaintiff or Defendant in litigation, the most important witness will likely be the corporation itself. The designated witness do not need to be the most knowledgeable on the identified topics in fact, personal knowledge often runs counter to corporate knowledge and an be hard to keep isolated.  As counsel to the corporation, your advice on picking and prepping the proper corporate representative will have immediate and long term impact.
