Primer for Successful Litigation Management:  How Experienced Trial Counsel Can Help Your Company Obtain an Optimal and Efficient Outcome Without Going to Trial

Less than 2% of litigation cases in the U.S. go to trial, the rest settle or resolve short of trial. Many corporations are disinclined to go to trial, so their objective is not only to settle, but (hopefully) settle for the optimal outcome. We have learned that the best way to settle a case favorably is not by preparing to settle, but by preparing to go to trial. Plaintiffs represented by experienced counsel won’t settle on favorable terms unless you demonstrate to them you are committed to trying the case and there is a meaningful chance they won’t prevail.  So, your defense counsel must demonstrate that you are prepared to present a persuasive case to the jury or trier of fact. This presentation talks about how experienced trial counsel can set your case up for settlement by preparing for trial, and as a result, obtain an optimal outcome without trial.
